General Terms and Conditions of Business

1. Provider and Scope

These General Terms and Conditions apply to services, digital products and other offerings provided by:

German Immigration Consultant and Expat Mentors are service names used by Sascha Markovic.

These Terms apply to paid and free offerings made available through immigration-consultant.de, Topmate, email or another individually agreed booking or payment method.

They apply to contracts with individual consumers as well as employers, companies and other organizations.

The version of these Terms available and accepted at the time of booking or purchase applies to the respective contract.

2. Nature of the Services

The services provided consist of general immigration information, practical orientation, process planning, job search support, career guidance and practical industry or HR insights.

The services do not include:

  • an individual legal assessment of eligibility for a particular residence title
  • legal advice or representation
  • legal review of applications, official decisions or refusals
  • submission of applications or communication with authorities on behalf of a client
  • tax advice
  • recruitment or job placement
  • guaranteed employer referrals or personal introductions
  • guaranteed visa approvals, job offers, processing times or other outcomes

Information is provided on the basis of published rules, official procedures and the information supplied by the client. Requirements and administrative practices may change, and clients should always check the current instructions of the responsible authority.

When a question requires legal advice or representation, the client should consult a licensed German immigration lawyer. Tax matters should be addressed to a qualified tax adviser.

3. Eligibility and Authority to Book

Paid services and digital products may only be booked or purchased by persons aged 18 or over.

A service concerning a person under the age of 18 must be booked by a parent or legal guardian. The parent or legal guardian becomes the contracting party and must participate in the service where appropriate.

A person booking on behalf of a company or another organization confirms that they are authorized to enter into the contract on its behalf.

4. Services and Service Descriptions

The scope of each service or digital product is determined by the description displayed on immigration-consultant.de or Topmate at the time of booking or purchase.

Current offerings may include:

  • Germany Immigration Calls
  • Job Search Consultations
  • the Job Search Guide for Germany
  • Expat Mentors individual sessions
  • Expat Mentors webinars and group sessions
  • free calculators, guides, forms and employer research
  • newsletter updates and other free informational resources

Additional communication, document review, follow-up support or other work is included only where it is expressly stated in the applicable service description or agreed separately in writing.

Services and products may be added, changed or discontinued for future bookings. Changes do not reduce the scope of a service that has already been purchased unless the client agrees.

5. Cooperation Partners and Mentors

Sascha Markovic is the client’s contractual partner for services offered under German Immigration Consultant and Expat Mentors.

Certain Expat Mentors sessions and webinars may be delivered by independent mentors, industry professionals or HR professionals acting as self-employed cooperation partners.

These cooperation partners are not employees of Sascha Markovic. They provide the session or contribution described in the applicable offer but do not become the client’s contractual partner unless this is expressly stated before booking.

Mentors provide practical insights based on their professional experience. They do not provide legal advice, job placement, guaranteed referrals or formal assessments of qualifications.

Where a particular mentor is announced for a webinar or session, that mentor will not be replaced without informing the client. If the mentor becomes unavailable, the session may be rescheduled or canceled. In the event of cancellation, the client receives a full refund.

6. Conclusion of the Contract

Bookings Through Topmate

A contract is concluded when the client completes the booking or purchase through Topmate, makes the required payment and receives a booking or purchase confirmation.

The contract for the booked service or digital product is between the client and Sascha Markovic. Topmate provides the booking, access and payment infrastructure but is not the provider of the professional service or content.

The client may also be required to accept Topmate’s own terms and refund policies. Those terms govern the separate relationship between the client and Topmate.

Bookings by Bank Transfer

Where payment by bank transfer is agreed, a contract is concluded when Sascha Markovic confirms the booking or order in writing and the agreed payment is received.

No appointment or delivery obligation arises merely from an inquiry, provisional discussion or invoice request.

7. Prices, Payments and Invoices

The price displayed during the Topmate checkout or stated in an individual written offer is the price charged for the service or digital product.

No additional taxes are added by Sascha Markovic to the displayed price.

Topmate may convert prices into another currency at the payment gateway. The final charged amount may vary slightly because of the exchange rate used by the payment provider. Banks, card issuers and payment providers may also charge their own fees.

Payments through Topmate are processed using the payment options shown at checkout, which may include PayPal and Razorpay. The payment description on the client’s account statement may refer to Topmate, Kavalry Technologies Private Limited or the relevant payment provider.

A Topmate booking or purchase confirmation is not an invoice issued by Sascha Markovic.

Invoices are issued by Sascha Markovic where required or requested. Business clients who need an invoice should provide their complete billing information.

Bank transfers may be accepted:

  • when payment through Topmate is not possible
  • following an individual request
  • when a company or organization requires an invoice and bank payment

Bank transfers may be made in euros or Serbian dinars, as stated on the invoice. The client must ensure that the full invoiced amount is received. Fees charged by the client’s bank, intermediary banks or payment provider are borne by the client.

Unless otherwise stated on the invoice, payment must be received before the service begins or the product is delivered.

8. Consumer Right of Withdrawal

Consumers may have a statutory right to withdraw from a distance contract within 14 days, depending on the law applicable to them.

Nothing in these Terms excludes or limits mandatory consumer rights.

Services Beginning Within 14 Days

Where a client books a service that begins during an applicable withdrawal period, the client may be asked to expressly request that preparation or performance begin before that period has expired.

Where legally required, the client will also be asked to acknowledge that the right of withdrawal may expire once the service has been fully performed.

If a consumer withdraws after performance has begun but before the service has been fully performed, the consequences are determined by the applicable mandatory law.

Digital Content With Immediate Access

The Job Search Guide for Germany is made available as digital content without a physical data carrier.

Where required by applicable law, immediate access is provided only after the consumer:

  • expressly agrees that delivery may begin before the withdrawal period has expired
  • acknowledges that the right of withdrawal may be lost when delivery begins

9. Cancellation, Rescheduling and No-Shows

This section applies to individual consultations and mentor sessions.

Cancellation by the Client

A client who cancels at least 24 hours before the scheduled start time is entitled to a full refund.

A cancellation made less than 24 hours before the scheduled start time is not refundable unless:

  • Sascha Markovic expressly agrees to a refund
  • exceptional circumstances justify a different solution
  • a refund is required by mandatory law
  • the applicable Topmate refund policy provides a more favorable right

Cancellations should be made through Topmate or by email.

Rescheduling

A consultation may be rescheduled free of charge up to eight hours before the scheduled start time.

Requests made less than eight hours before the start time may be accepted at the discretion of Sascha Markovic but there is no automatic right to reschedule.

Late Arrival

Late arrival does not extend the scheduled end time.

If the client does not join within the first 20 minutes, the session ends and is treated as a no-show. No refund is provided unless mandatory law requires otherwise.

Cancellation by Sascha Markovic

If Sascha Markovic or the announced mentor cancels a session, the client may choose between:

  • a suitable replacement appointment
  • a full refund

A full refund is also provided when Sascha Markovic determines before the session that the client’s question requires legal advice or another service that cannot be provided within the booked scope.

Refunds made through Topmate are processed through the original payment method and may be subject to Topmate’s or the payment provider’s processing time.

10. Technical Problems

Clients are responsible for having a suitable device, functioning audio and video where needed, a stable internet connection and access to the chosen meeting platform.

Google Meet is the standard platform for consultations. Zoom or Microsoft Teams may be used by agreement.

Where a technical problem attributable to Sascha Markovic, a cooperation partner or the selected platform prevents the session from taking place or substantially reduces its duration, an appropriate solution will be offered. This may include:

  • continuing through another meeting link
  • completing the missing part at another time
  • rescheduling the session
  • a proportionate refund
  • a full refund where the service could not be delivered

Technical problems involving the client’s device, software or internet connection do not normally create a right to a refund. A discretionary rescheduling may be offered depending on the circumstances.

11. Digital Products

The Job Search Guide for Germany is currently the only paid digital download product.

The purchaser receives a personal, non-exclusive and non-transferable right to use the product for private or internal professional purposes.

The purchaser may not:

  • share the download link or file with another person
  • upload the product to a website, cloud folder, group or file-sharing service
  • publish, reproduce or distribute substantial parts of the product
  • sell, sublicense or commercially redistribute the product
  • remove copyright or authorship notices

Access is provided through Topmate.

Updated files may be added to the Topmate download area. Previous purchasers may download updated versions made available there without an additional charge.

Updated versions are not necessarily sent by email. The purchaser is responsible for checking the Topmate download area.

There is no obligation to produce a particular update, maintain a specific publication schedule or create a completely new edition.

Access is intended to remain available through the purchaser’s Topmate account. Continued access depends on the availability of Topmate and the purchaser’s account. Indefinite operation of a third-party platform cannot be guaranteed.

Except where mandatory law provides otherwise, a refund is not available after the digital product has been successfully accessed or downloaded merely because the purchaser changes their mind or the content does not meet personal expectations.

This does not affect rights relating to defective, inaccessible or materially misdescribed digital content. Where access fails, an attempt will first be made to restore access or provide the file again.

Topmate’s current policy similarly distinguishes between inaccessible digital products and products that have already been accessed, while expressly preserving mandatory statutory rights.

12. Expat Mentors Webinars and Group Sessions

A minimum of ten paid participants may be required for an Expat Mentors webinar.

If the minimum number is not reached, the webinar may be canceled. Participants receive a full refund or may agree to transfer their booking to a replacement date.

If the announced mentor is unavailable, the mentor will not automatically be replaced. The webinar may instead be rescheduled or canceled. A participant who does not accept the replacement date receives a full refund.

Webinars may be recorded when this is stated in the service description. Participants will be informed before the recording begins.

Where the recording may include a participant’s voice, image, name, chat message or other identifiable contribution, the necessary consent will be requested separately.

Participants who book a recorded webinar receive access to the recording as described in the applicable offer.

Participants may not:

  • record the webinar independently without permission
  • share the webinar recording or access link
  • publish statements made by mentors or other participants
  • disclose personal information or contact details of other participants
  • use the webinar to approach, recruit or market to other participants without their consent

Webinars provide general industry and HR insights. They do not include job placement, recommendations to employers, guaranteed introductions, individual legal advice or formal immigration assessments.

Failure to attend a webinar does not create a right to a refund where the webinar was delivered as described and the recording was made available as promised.

13. Communication

General communication may take place through:

  • email
  • WhatsApp
  • Viber
  • Topmate messages
  • the communication functions of the selected meeting platform

Booking confirmations, purchase confirmations and access information are normally sent through Topmate.

Cancellations, rescheduling requests and other important contractual messages should be sent through Topmate or by email so that they can be properly documented.

WhatsApp and Viber may be used for general communication and urgent messages relating to a session. They should not be relied upon as the only method for sending important documents or formal notices.

Communication outside a booked session is included only where the applicable service description expressly provides for follow-up support.

Clients are responsible for providing accurate contact details and checking their email inbox, spam folder and Topmate account for booking information.

14. Third-Party Platforms

Third-party platforms are used to provide parts of the website and services.

These currently include:

  • Topmate for bookings, payments and digital product delivery
  • Beehiiv for the newsletter and delivery of employer list updates
  • Tally for calculators and forms
  • Google Meet for standard video consultations
  • Zoom and Microsoft Teams where agreed

Use of these platforms may also be subject to their own terms and privacy policies.

Beehiiv processes newsletter subscriber information on behalf of the publisher, while requiring the publisher to provide required notices and obtain legally necessary consent.

Tally provides the technical infrastructure for certain forms and calculators and treats professional form creators as its customers under its professional terms.

The newsletter is free. There are currently no paid newsletter subscriptions, automatic paid renewals, advertising network services or other paid Beehiiv subscriber products.

Subscribers may unsubscribe at any time using the link provided in each newsletter.

The Opportunity Card Calculator can be used anonymously. Where users choose to provide their name and email address or subscribe to the newsletter, the corresponding information is processed as described in the Privacy Policy.

Calculator results are generated from the information entered. They do not verify qualifications, documents, language certificates, professional experience or financial evidence and do not constitute an official or legal assessment.

15. Recordings

Individual consultations are not recorded unless every participant has given prior express consent.

Neither the client nor any other participant may independently record, transcribe or distribute a consultation without the prior express consent of everyone taking part.

Separate rules for announced webinar recordings are set out in Section 12.

16. Client Responsibilities

Clients must provide accurate and sufficiently complete information for the booked service.

Clients are responsible for:

  • supplying requested information and materials in time
  • ensuring that they are entitled to share any documents or personal information submitted
  • checking official requirements before taking action
  • making their own decisions about immigration, employment, applications and relocation
  • attending sessions on time
  • communicating respectfully with Sascha Markovic, mentors and other participants

A session may be ended where a participant behaves abusively, threateningly, discriminatorily or in another seriously inappropriate manner. A refund is not provided in such cases unless required by mandatory law.

17. Intellectual Property

Unless otherwise indicated, the website content, guides, templates, webinar materials, recordings, written summaries and other materials provided through the services are owned by Sascha Markovic or used with permission.

They may be used only for the purpose and within the scope for which they were provided.

Materials supplied by a client remain the property of the client or their respective rights holder. The client grants Sascha Markovic and, where necessary, the relevant cooperation partner permission to review and use the materials solely for delivering the booked service.

18. Confidentiality and Data Protection

Information provided in connection with an individual consultation is treated confidentially and used only for delivering the service, managing the contractual relationship and fulfilling applicable legal obligations.

Where a cooperation partner provides a booked service, relevant client information may be shared with that partner to the extent necessary to prepare for and deliver the service.

Further information about the collection, use, storage and sharing of personal data is provided in the Privacy Policy.

Confidentiality does not prevent disclosure where required by law, a court order or a competent authority, or where necessary to protect legitimate rights or safety.

19. No Guarantee and Liability

Services, tools and materials are prepared with reasonable care and based on the information available at the relevant time.

No guarantee is given that:

  • an authority will accept an application or document
  • a particular immigration pathway will be available
  • a client will receive a visa or residence permit
  • a qualification will be recognized
  • an employer will respond or make a job offer
  • a particular salary, processing time or relocation outcome will be achieved
  • external websites, platforms or official procedures will remain unchanged

Clients remain responsible for decisions made on the basis of the information provided.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for intentional misconduct, gross negligence, death, personal injury or mandatory consumer rights.

To the extent permitted by applicable law, liability for ordinary negligence is limited to reasonably foreseeable damage resulting from the breach of an essential contractual obligation.

Sascha Markovic is not responsible for decisions or actions of authorities, employers, payment providers, third-party platforms, lawyers, tax advisers or other independent professionals.

20. Referrals to Lawyers and Other Specialists

Lawyers, tax advisers and other specialists recommended to a client operate independently.

A separate contract is concluded directly between the client and the specialist. These Terms do not apply to that separate engagement.

Sascha Markovic receives no commission for referring clients to lawyers or tax advisers.

A referral does not guarantee the specialist’s availability, acceptance of the matter or the result of their work.

21. Events Beyond Reasonable Control

Neither party is liable for delay or non-performance caused by circumstances beyond reasonable control, including major internet or telecommunications failures, natural disasters, serious illness, government restrictions, war, civil unrest or widespread platform outages.

The affected party should inform the other party as soon as reasonably possible. Where the service cannot be provided within a reasonable time, the client may receive a replacement date or refund as appropriate.

22. Changes to These Terms

Updated Terms apply to future bookings and purchases from the date on which they are published.

The version accepted at the time of booking or purchase continues to apply to that contract unless:

  • a change is required by mandatory law
  • the change is exclusively beneficial to the client
  • both parties expressly agree to the change

Silence or failure to object to a new version does not automatically amend an existing contract.

23. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Serbia.

This choice of law does not deprive consumers of mandatory protections granted to them under the law of their country of habitual residence.

For consumers, the courts with jurisdiction under applicable mandatory law remain competent.

For contracts with companies, organizations and other clients acting for commercial or professional purposes, the courts of Belgrade, Serbia, have exclusive jurisdiction, to the extent permitted by law.

24. Language, Severability and Waiver

These Terms are provided in English.

Where a translation is made available, the English version prevails unless mandatory law requires otherwise.

If an individual provision is invalid or unenforceable, the remaining provisions continue to apply. The invalid provision will be replaced only to the extent permitted by applicable law.

Failure to enforce a contractual right in one instance does not constitute a permanent waiver of that right.

Withdrawal Information

The following information applies to consumers who book services or purchase digital content remotely.

A consumer is a natural person who enters into a contract mainly for purposes that are outside their trade, business or profession.

1. Withdrawal Information for Services

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the date on which the contract is concluded.

To exercise your right of withdrawal, you must inform:

of your decision to withdraw from the contract by means of a clear statement, for example by email or letter sent by post.

You may use the model withdrawal form provided below, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, I will reimburse all payments received from you without undue delay and no later than 14 days from the date on which I receive your notice of withdrawal.

I will reimburse you using the same means of payment that you used for the original transaction, unless we expressly agree otherwise. You will not incur any fees from me as a result of the reimbursement.

Services Started During the Withdrawal Period

If you expressly requested that the booked service begin before the end of the 14-day withdrawal period, you must pay a reasonable amount for the part of the service provided before you informed me of your decision to withdraw.

This amount will be calculated in proportion to the full scope of the service agreed in the contract.

Preparation carried out before the consultation may form part of the service where preparation is expressly included in the booked service description.

Early Expiry of the Right of Withdrawal

Your right of withdrawal expires once the service has been fully performed, provided that:

  • you expressly requested that performance begin before the end of the withdrawal period, and
  • you acknowledged that you would lose your right of withdrawal once the service had been fully performed.

This early expiry does not affect any separate contractual cancellation or refund rights that may be more favorable to you.

German law distinguishes between the start of a paid service and its complete performance. An express request is relevant when work begins during the withdrawal period, while the withdrawal right generally expires only after complete performance and the required acknowledgment.

 


 

2. Withdrawal Information for Digital Content

This section applies to digital content supplied without a physical data carrier, including the Job Search Guide for Germany.

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the date on which the contract is concluded.

To exercise your right of withdrawal, you must inform:

Effects of Withdrawal

If you validly withdraw before the digital content has been supplied or before your right of withdrawal has expired, I will reimburse all payments received from you without undue delay and no later than 14 days from the date on which I receive your notice of withdrawal.

I will reimburse you using the same means of payment that you used for the original transaction, unless we expressly agree otherwise. You will not incur any fees from me as a result of the reimbursement.

Early Expiry of the Right of Withdrawal

Your right of withdrawal expires when the supply of the digital content begins, provided that:

  • you expressly consented to receiving access before the end of the 14-day withdrawal period,
  • you acknowledged that you would lose your right of withdrawal when the supply began, and
  • you received confirmation of the contract and your consent on a durable medium, such as email.

If these conditions have not been met, your statutory right of withdrawal is not excluded merely because the product was described as an instant download.

Once a valid withdrawal has been made, digital content may no longer be used, copied or made available to another person.
